The first thing you should do when initially contacted by a debt collector is Demand PROPER debt validation. That simply means that you want proof of the debt. Third party debt collectors often purchase debt that is outdated and past the statute of limitations. If a debt that you owed is past the statute of limitations, once you pay on it, you will reactivate the debt. Debt collectors almost never have proper debt validation and if you admit to the debt or make any statements over the phone, you may end up having to pay a debt that you otherwise would not have had to pay.
IMPORTANT: If the debt collector CAN NOT properly validate the debt, then you don’t have to pay them.
Send the debt collector a cease and desist letter requesting that they not contact you by phone. The cease and desist letter will give you some relief if the debt collector is constantly calling you. The cease and desist letter informs the debt collector not to call you on the phone. You don’t want to cease all communication because if the debt collector takes legal action against you, they’ll notify you by mail.
